• A fully interactive revolver which can be manipulated and spun freely.
• A tacticool outfit made mostly from scratch.
• A custom rig for Zinpia's Zinfit base to allow for almost realistic physics
• A lot of 'wholesome' features planned.

PRODIGY Avatar - Terms of Service

By purchasing your preorder tiket and using the PRODIGY avatar ("Avatar") after release, you agree to the following terms and conditions. Please read these terms carefully before proceeding with your purchase. If you do not agree with any of these terms, refrain from purchasing and using the Avatar.

1. License and Usage:

PRODIGY is intended for personal, non-commercial use within the VRChat platform. Upon purchase, you are granted a non-exclusive, non-transferable license to use the Avatar solely for your own personal enjoyment and interactions within VRChat.

2. Restrictions:

You are expressly prohibited from modifying, distributing, reselling, or otherwise exploiting the Avatar for any commercial* purpose, including but not limited to virtual goods markets or other virtual platforms. You may not use the Avatar in any way that infringes upon the intellectual property rights of the creator.

*usage on any video streaming platform does not fall under commercial usage and thus is allowed if the avatar or the creator of the avatar is credited accordingly.

3. Content Usage:

You understand that the Avatar's design, artwork, and intellectual property are the exclusive property of the creator. You may not use, modify, or reproduce any part of the Avatar for any purpose outside of its intended use within VRChat.

4. Refunds:

All sales of the Avatar are final. Due to the digital nature of the product, refunds will not be issued except in cases where the Avatar is found to be significantly different from its advertised description.

5. Updates and Support:

The creator reserves the right to provide updates and improvements to the Avatar over time. However, there is no obligation to provide ongoing support, and the creator may discontinue updates at any time.

6. Compliance with VRChat Terms of Service:

You must comply with VRChat's Terms of Service (TOS) and Community Guidelines while using the Avatar. Any violations of VRChat's TOS or guidelines that are associated with your use of the Avatar are solely your responsibility.

7. Limitation of Liability:

The creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use the Avatar, even if the creator has been advised of the possibility of such damages.

8. Indemnification:

You agree to indemnify and hold harmless the creator from any claims, liabilities, losses, costs, or expenses arising from your use of the Avatar or any violations of these terms.

9. Termination:

This license is effective until terminated by the creator. The creator reserves the right to terminate this license and your access to the Avatar at any time if you fail to comply with these terms.

10. Governing Law:

These terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

11. Preorder Specific:

By "Preordering" or securing your purchase of a limited edition of the product, the avatar creator reserves the right of making the purchase void under any circumstance.
The preorderer of the avatar has a right of refund of their purchase for the following situations:

• The updates to the preorders haven't had any traction for a year on the product page or discord server.
• The project has been abandoned by the creator.
• Multiple delays to deadlines put by the creator either on the product page or discord server.

In the case the creator has made a preorder purchase void, the preorderer is liable for any damage that may follow the decision that has led to a void purchase.

Preorders will last as long as the creator decides, with or without a deadline date.
Any features listed in the features list above and the appearance of the avatar are susceptible to change, these may expand or contract depending on feedback or creator's choice.

By proceeding with your preorder purchase of the PRODIGY Avatar, you acknowledge that you have read, understood, and agreed to abide by these Terms of Service.
